Ariytek provides for an online marketplace where it offers to sell their respective products to registered users of the website (“Buyers”).

The terms and conditions (the “Agreement”) set forth below and the standard terms and conditions that apply to and governs your use of the website www.airytek.com and the services available thereon constitute a legally binding agreement between Enterprises (the “Company”) and you. This Agreement contains provisions that define limits, legal rights and obligations with respect to the use of the website www.airytek.com that is conceptualized, developed and hosted by the Company (hereinafter referred to as the “Platform”) including its classified services, forums, chats, classified advertisements, related sites (the “Content”) that applies to all the users of the Platform including without limitation users who are browsers, Suppliers, Resellers, merchants, or contributors of content (collectively, “User”).

The Platform is currently owned, operated and controlled by Airytek Enterprises.

By even merely visiting or accessing any part of the Platform or utilising any services offered on the Platform the Terms of Use described below incorporate the Privacy Policy and apply to all users of the Platform.

ACCEPTANCE OF TERMS OF USE:

User acknowledges and understands that the Platform serves as an online marketplace where the company offers to sell its products to registered users of the platform and by using, visiting, registering and/or otherwise accessing the Platform and by confirming that you have read the Terms of Use, you hereby certify that:

• You have the authority to enter into these Terms of Use (ii) you agree to be bound by the Terms of Use and any other documents incorporated
• You are of legal age to form a binding contract and are not a person barred from receiving services under the laws of any applicable jurisdiction in which the Company conducts
• Airytek’s responsibility in respect of any order is fulfilled upon successful handover of the correctly packed, sealed, and documented goods to the customer’s chosen courier or delivery partner. From the point of handover to the courier, the delivery partner assumes full operational responsibility for the safe and timely transit of the goods to the customer’s specified delivery address

IF THE USER DOES NOT AGREE WITH THESE TERMS, THE USER IS ADVISED TO REFRAIN FROM USING THE PLATFORM. BY ACCESSING OR USING THE PLATFORM, THE USER IRREVOCABLY ACCEPTS THE AGREEMENT AND AGREES TO ABIDE BY THE SAME (AS UPDATED FROM TIME TO TIME).

USER ELIGIBILITY: 

• User(s) represent and warrant that they have the right to access or use the Platform. Persons who are “incompetent to contract” within the meaning of the Indian Contract Act, 1872 including minors, un-discharged insolvents etc. are not eligible to access and use the

Acceptance of Service by Airytek (by AIRYTECH ENTERPRISES )

By placing an order on airytek.com, the customer confirms that they have read and understood the product description, specifications, and all associated terms. The customer accepts full responsibility for verifying that the product meets their requirements before completing the purchase. Once an order is placed and payment is confirmed, the customer is deemed to have accepted the product “as described” on our website at the time of purchase.

Delivery Acceptance Policy

Upon receipt of delivery, the customer is required to inspect the outer packaging before accepting the parcel from the courier. If the outer packaging shows visible signs of damage, tampering, or resealing, the customer must refuse delivery and notify us immediately at support@airytek.com. Acceptance of the parcel from the courier constitutes the customer’s confirmation that the outer packaging was received in acceptable condition. Airytek will not be held liable for claims of tampered or opened outer packaging where delivery was accepted without objection at the time of handover.

Wrong Item or Missing Item Claims

In the event a customer believes they have received an incorrect or incomplete order, the following procedure must be followed within 2 hours of delivery. The customer must contact airytek at support@airytek.com or via WhatsApp with photographic and video evidence ( all sides of box should be shown clearly) of the unopened outer packaging, the inner packaging, and the alleged incorrect contents. The customer must retain all original packaging materials including the outer shipping carton, inner retail box, and all accessories received, as these may be required for investigation. The customer must agree to participate in a live video verification call with an Airytek representative within 24 hours of raising the claim, to independently verify the alleged contents and cross-check against our dispatch records. Failure to report within 2 hours of delivery, failure to retain original packaging, or failure to cooperate with live verification will result in the claim being considered invalid and no refund or replacement will be issued.

Refund Eligibility and Investigation

Refunds are not issued upon receipt of a complaint, we only provide replacement upon receiving the send shipment back. All claims of wrong delivery, missing items, or non-delivery are subject to a formal internal investigation. A replacement will only be considered after: verification of the claim through live video inspection, cross-referencing of the alleged contents against our dispatch records and courier documentation, and confirmation that the claim is genuine and not the result of post-delivery tampering. Airytek reserves the right to withhold a refund indefinitely pending the outcome of an investigation. Where evidence of fraud or deliberate misrepresentation is found, no replacement will be issued and the matter will be referred to appropriate legal and law enforcement authorities. Evidence Submission Requirements

Any evidence submitted in support of a claim including photographs and videos must be original and unedited files submitted directly from the recording device. Evidence shared via third-party cloud links including Google Drive, Dropbox, or similar platforms will not be accepted as tamper proof evidence. Airytek reserves the right to request the original file with full metadata including creation timestamp, recording device information, and GPS data. Refusal to provide original files when requested will be treated as non-cooperation and the claim will be considered invalid.

Customer Cooperation Requirement

The customer agrees to cooperate fully and promptly with any investigation initiated by Airytek in connection with a delivery claim. Cooperation includes but is not limited to: attending live video verification calls when requested, providing government-issued identity proof for formal investigations, completing any formal declaration or grievance form issued by Airytek, and making the alleged received items available for physical inspection if requested. Refusal to cooperate with any reasonable verification request, or insistence on communicating only through pre-recorded media, will be treated as a breach of these terms and will result in the claim being rejected.

Fraud and Misrepresentation

Airytek takes all fraudulent claims extremely seriously. Submitting false, staged, or fabricated evidence in support of a delivery claim, filing a chargeback on the basis of a fraudulent or exaggerated claim, and making false representations about the condition or contents of a delivered parcel are all considered serious offences. In such cases Airytek reserves the right to reject the claim in its entirety, report the matter to law enforcement authorities, contest any chargeback filed with the card network and provide all available evidence to the payment processor and issuing bank, and pursue civil and criminal remedies against the customer including recovery of all costs incurred in investigating and contesting the fraudulent claim. Customers are advised that all communications including email and WhatsApp are recorded and may be submitted as electronic evidence under the Information Technology Act, 2000.

Chargeback Policy

By completing a purchase on Airytek, the customer agrees to contact Airytek directly and follow the claims procedure outlined above before initiating any chargeback with their card issuing bank. Filing a chargeback without first completing Airytek’s internal claims process constitutes a breach of these terms. Where a chargeback is filed, Airytek will submit all available evidence to the payment processor including delivery records, courier documentation, communication logs, and any forensic analysis of submitted evidence. Customers who file chargebacks that are subsequently found to be fraudulent or unsubstantiated will be permanently blacklisted from placing future orders on Airytek.

ACCOUNT REGISTRATION

• Users may access the Platform by registering to create an account and become a member. The membership is limited for the purpose of buying products, is subject to these Terms, and strictly not

EXCLUSION OF LIABILITY:

• Impersonate another person or entity; or

• The Platform will be accessible without interruption or in a timely, reliable, or fault-free manner; or
• The results obtained through the use of the Platform will be correct and reliable; or
• The quality of the products, services, information, or other material purchased or obtained by the User through the Platform will meet the User’s
• The Users shall be solely responsible for damages to their data system or for loss of data arising from the download of content from the Platform
• No guidance or information, written or oral, obtained from the Company or via the Platform, shall constitute any warranty unless stated

Losses

The Company will not be responsible for any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure) or any other indirect or consequential loss that is not reasonably foreseeable to both the User and the Company when the User commenced using the Platform.

Events beyond our reasonable control

USER-PROVIDED CONTENT:
